The SEC's investigations are done almost as quietly as a police investigation and for the same reason. They don't want the criminals to hide any evidence or flee the country.

Unfortunately for Kevin, he can't hide the fact that the Greenshift Corporation hasn't filed anything with the SEC since the third quarter of 2016!

In any of those instances, do you have documented proof, or insider info that Gers did things maliciously?

It's ridiculously easy to prove that the Greenshift Corporation hasn't filed some legally-required 10-Q and 10-K reports. The company publishes, on their own website, a list of the reports that they DID file with the SEC. This list, arranged chronologically, ends with the 10-Q for the third quarter of 2016.

It's unnecessary for the SEC to show a malicious intent. All they have to do, in a U.S. Court, is to show that there is a statutory requirement to file the reports and that the Greenshift Corporation failed to obey that law.

Drivers in the Unites States have a legal requirement to drive on the right-hand side of the road. Any driver who fails this legally-required action is eligible to be fined and penalized by his insurance company.
