Well, given that there is NO remaining life on the patents, it is as I posited, all dependent on successfully appealing the patent date and having the lost years tacked on going forward.

Re: attorneys fees, yes, I would assume so. I just think it unlikely that they will want to continue to be connected to us for the remaining years - should we prevail in that appeal - to collect their percentage.
What that probably means is that any settlement will NOT include any negotiations re: future royalties, and we'll address that separately.

In any case, if we get a vacate, I'd like to see the next filing be to appeal the decision on the patent date so we can get it cleared up and the new years put in place for the next round of infringement action.
