'spockster202' Interesting post (to me LOL ) as I have done "just that" related to a non disclosed "Prescriptive Easement" on the Title Report developed by 'First American Title'. Title company tried to BS me to get a lawyer bla bla bla > Instead I hired a Surveyor then I did hire a Lawyer and paid him to send 2 letters,one to my neighbors about my intentions to build a fence to witch they replied they would sue me.The other to the Title Company with a copy of that neighbor reply asking them to pay my claim. ( cost $150 Lawyer )
First American Title then hired a "diminution of value survey" preformed to that properly, ( cost $ 5,000+ ) paid for my Registered Survey ( cost $ 4,000 ) sent me a check for $34,000 Total cost to First American about $50,000
and I bought stock with the money SLJB what elce LOL
note : First American Title payout on claims is in the 3 % Range > boy do they make money
I love Title Insurance LOL
