As it is there are a number of other fraudulent crypto cases before the courts and in those, as with this one, this judges decision will determine if the CFTC has jurisdiction in any of them [in so far as is crypto a commodity or not]. Another judge has already observed that this technical debate is obscuring the immediate crimes that were committed and delaying the subsequent punishment for same. Either way, with or without the CFTC and this hearing other Federal agencies are waiting their turn. This case simply determines their playbook.
