As far as them being "victims of cyber crime"...OTC and the SEC beg to differ. Here's the SEC's 45 page report on he matter.
Ljubica stupidly filed a response to the SEC's initial investigation and swore "under penalty of perjury" that it contained no untrue statement. Apparently she's unaware that there is no "safe harbor statement" that will protect her from lying to a Federal agency. Whether they choose to prosecute her or not remains to be seen. IMO they both need to quietly fade away and make sure they don't use surrogates to try and rehab their reputations.
