IMO yes and no.

Its good that Keevil filed a suit because the truth will come out in court.
That was why Dan should have filed. He didnt. He let Scott into the drivers seat.

So now Dan has a counter suit. Better late than never I guess but in this case not so much. Since he is a counter suit he will be handeled AFTER the original suit.

They will hear Scotts complaint and decide if he is right or wrong. Then they will hear the counter suit to see if it nullifies Scotts claims.

Problem being Scotts claims will never be heard. He has no intention to step in the court room. He has a suit filed and can delay it until the courts throw it out.
Dan CANT file suit against Scott until the current case is closed because he has a case filed. He should have filed first and he could be in control and drag Scott into the courts.

Scotts lawyers played Dan like a fiddle.

Dan is stuck for years. He now has a choice. Do nothing and screw over the shareholders or continue forward and make the company into something only to have Scott take it away if he wins.

Hard spot to be in. I personally would do my job and make the company worth at least .03 and sell out. Take back what you can and abandon the company to scott
