I kinda wondered why the jury ended up deciding the validity of the patent instead of sticking to the order of the day... infringed or not? They've decided that Amphastar infringed but what did they infringed on when the patent was invalid? … crazy... I know the judge gave them a questionnaire to help them make that decision.... a QUESTIONAIRE?... imagine doing that to decide that APPLE infringed on a Samsung patent!... that won't fly... I think..
well, this just enforces the image that Momenta is a clutch kid... they can't do things right. they can't even meet their announcement date.. let alone make an enforceable patent... but I'm a sucker for the underdog... I hold
Anyway, I think that way out theory I cast out a couple of days ago may still come to fruition... Judge reverses decision Amphastar to pay Momenta $1 Billion!.. To Da Moooon!..
