Mark DeStefano is 0 for 2 in his custodianships now.

NNRX custodianship had been conditionally granted when old management stepped back into the picture. They claimed they had not been properly served due to address errors and that they were in fact still in business, albeit unreporting. DeStefano got the boot. Had his work been sloppy intentionally? I don't know.

For CPOW he requested voluntary dismissal of entire action last week. My guess is old management once again reared their ugly head and DeStefano had learned his lesson previously and decided to just cut his losses instead of fighting. There were two things I had noted. One was that in addition to just the normal asking for custodianship he also asked for a Default Judgment. I don't remember seeing that in other custodianship cases. Then again, maybe that doesn't mean anything at all. The other thing I noted was a request to move up the hearing date from 7/26 with the reason being that NV was due to permanently revoke the charter 10/31. As I understand it, there's nothing actually "permanent" about it - it just costs more to reinstate.

But really, being worried that more than 3 months was not enough time for him to reinstate if he got custodianship? That doesn't sound right. I have no proof, but I have my suspicion that he found out old management was aware and perhaps he was trying to speed up the process so he could take steps to lock them out before they could intervene. I could certainly be wrong...

It will be interesting to see if he tries another custodianship. And if his work will be sloppy again or if tries to do things properly. As of now I don't trust him further than I can throw him. And with my bad back, I shouldn't be throwing anybody.
