With a self-imposed deadline approaching, I can only guess that the deliberation stage had been completed & decision(s) had been made, and it is now a matter of putting the panel's deliberation into writing.

Will it be 3-0 or 2-1 decision, and most important of all will the majority decision be a remand or a vacate opinion? I'm going to go out on a limb here and predict the court applies de novo review standard and it will be 3-0 vacating decision.
