According to the financials, the notes are all restricted in their conversions to never be at more than 4.99% of the outstanding so the outstanding could only marginally increase over time from the convertibles. In essence, they have done what you are suggesting and contractually limited all conversions. When you couple that in with market volume restrictions the convertibles are very very much in control.
