There is some dirty play that occurs, but I consider the likelihood of a FDA payoff to be near zero. However, it would not surprise me if another company with a competitive agenda might have submitted tox data on their programs to the FDA in the hope of stirring the pot regarding worries about Cortex's program. That kind of dirty trick--where it can be cloaked as simple disclosure in the public health interest--can happen. I have no proof that it did here, but I believe that any tricks would have been of this type, if they existed at all.
