I have not adequately explained just how much this changes the dynamics of the litigation. I have been doing research not only on civil and criminal liability for industrial espionage, but also industrial espionage as a predicate crime in a civil RICO action. Much still to learn, and it will be interesting to see when Elysium answers the Fourth Amended Complaint whether they say it didn't happen or it doesn't matter. But in the short term, I don't think the schedules change much (except that the parties have agreed to add three months to Discovery), and it's hard to imagine mutually agreeable settlement terms, so I just think we probably keep on keeping on, only with a clearer sense of how it all comes out.
