JTFM, I recall many patent applications containing safety and efficacy "claims"(in specification and even actual numbered claims) for which no specific data was supplied. Courts have held that utility "claims" or assertions of that sort may not be challenged by PTO unless PTO can supply evidence that such claims are incredible, or impossible, and would not be believed by those skilled in the art.
