Perhaps Tony would be cooperative with the SEC and the ALJ by not wasting their time and capital and offer a settlement by consenting to the Section 12(j) and get it over with.

IF he/they ever try to engage as an officer or director of a company in which he/they are required to file with the SEC...well, we get the drift.

If we think Janice and Nodummy keep databases of names, so does the SEC and FINRA.
