I don't think this is a lawsuit about free speech. Bass could have done interviews and set up his website claiming UDF was a Ponzi scheme.

I think this lawsuit is about Bass' coordinated and planned effort to thoroughly attack a company and interfere with existing contracts. He simultaneously coordinated efforts on UDF's banks, investors, auditors, city officials (who approve entitlements on land), LinkedIn accounting community, google Adwords, FBI, FINRA, SEC, etc.

I think its one thing to use free speech and share research/opinion about a company. It's entirely another to accumulate a massive short position relative to the float and then scheme to take down a company. The internal emails and texts suggest there was more than just free speech. It could have crossed the line into illegal activity, when taken as a whole.
