I wish that were true, but the SEC will still exempt that documentation until the period for bringing an enforcement action is complete.

Which is 5 years.

It is rare, but the SEC will, on occasion, reopen an investigation if new evidence (or new violations) occur. Which is why they will not release that information until the 5 years is up.

And that is a fact.

And even then the files may not be released. The SEC can easily categorize documents related to an investigation, closed or not, as falling within one of their exemptions for FOIA releases.
