All one has to do is file a FOIA request to obtain any and all documentation related to an official investigation



Actually, you can't. Not only are materials related to any SEC investigation exempt from FOIA requests, the SEC does the same to any company which MAY be subject to a formal investigation in the future. That includes any delinquent filer.

Based on experience, the SEC will simply state those materials are not available.
