There are fines and criminal penalties for fraudulent accounting statements. Specifically, there are penalties under Sarbanes-Oxley including up to 10 years in prison and a $1,00,000,000 fine for a CEO who recklessly violates his certification of company financial statements.
I don't think Mr. Bailey would jeopardize his successful career and numerous well-paid position at other well known companies by signing fraudulent financial statements of On4communications.
