The FDA has clearly stated, but the FDA is not following the law when it clearly states what it does. Instead, it is relying on guidance that they created. Congress recently passed a law that says the FDA cannot go after a company based solely on their guidance.

The case will eventually hinge on the words "minimally manipulated." The FDA will attempt to use it's guidance to prove that USRM did wrong. USRM will likely point to other procedures such as the donation of plasma as the more accurate definition of "minimally manipulated."

In the end, I believe that any judge worth his salt will find that USRM is in the right.
