It depends on your risk tolerance. Cases not yet decided are perfectly reasonable to be considered in making investment decisions. Not to consider other potential cases, as yet undecided, in an investment involving patent law such as WDDD would be an oversight IMO.

You can repeat your point as often as you like, but it doesn't change the error in your point. The other case could strengthen WDDD's case, could weaken it, or could have no effect at all. To suggest any of these "coulds" should not be considered in making an investment decision here is a bit preposterous.
