This is the pre and post AIA argument I talked about during Oil States.

Questions-
This is sent to the CAFC correct?
If so why? From the quick glance they are either asking for a stay until this issue is decided or are asking the cAFC to decide this issue for them.
Which, I might be wrong, but the cAFC doens't have authority to decide this.
I get if the Pre and Post AIA gets implemented it is great for us, we are golden. In the short term though, that isn't happening and wDDD case is progressing along.
Our CAFC decision will come down before anything is done by them on this.
I am not sure the CAFC can do anything about this.
SCOTUS left the door open, but as far as I know they have no cases pending or that they are looking at taking that will involve this. So the issue is left undecided.
I understand this might encourage some buying, but I simply don't see how this helps us, or am I missing something?
