The problem is that they are selling tokens as investment instruments (with the expectation of rise of value) and before there are products that can use them (in all cases) - so it fails a couple of key expectations of the Howie test.

Yes that test is old, but it will be good once and for all to get a court to rule on how to interpret some of these new fangled investions
