BPAX patents related to reducing CV events and the risk of CV events were published in January 2012 and on February 7, 2012, The patent office received a request to change the Power of Attorney for these applications to Abbott Lab's lawyers. I believe the Non-disclosure agreement was formalized around this time.

Interestingly both a/n patent applications include as parent in part or a division of patent application # 09/651,777 (Patent #6,503,894). A review of the 34 Child Data entries related to this patent application only one stands out as Pending.

13/648,694 filed on 10-10-2012 which is Pending claims the benefit of 09/651,777

Filed 6 days after BPAX and ANIP announced the proposed merger on October 4, 2012. Is it related? I don't know, but given the fact Dr Snabes is with AbbVie, it may very well be.
