Even in this case, what IP is saying is that Bermans PR indicates that Berman may try file a strike suit to possibly have an effect on the sale (this implies that the current case will not have that effect as it currently stands). This will most likely fail miserably since the patents are expired. I am not even convinced Berman will go down this road. Looks like strawman to me.
