I just don't see why he would. (It could be I'm reading over it in your posts)

IMO all RS that have occurred where necessary to enable more dilution.
The dilution was needed to generate money.
At this time it doesn't seem like he wants to dilute, and he doesn't seem in desperate need for money.
Greenshift might be generating enough income, and the litigation seems payed for by CC.

To perform a RS just to get the SP higher seems unnecessary at this time. If he wants to take GERS out of the pennies, he will do so after the lawsuit has ended. And we can expect the price to get above $1 at easy at that time.

If he wants to perform a RS to get less OS, with only 20 million shares available at this time, also makes no sense to me.
