I don't know what may be a lie on Pessin's part but it seems like he was a victim of his partners actions. The judge is going to look at the entity of DFC not whether Pessin knew of any fraud that was going on.
He really attempted to bash Thomas in there also. He basically said Thomas is just a greedy investor trying to make money, well...not sure what to tell him. That is kind of the idea of investing.
Hopefully we have something showing we actually did own the "Fund.com" URL and if we can do that I'm not worried about the summary judgement. If Pessing is being honest, he purchased the URL from someone who did not actually own it. We should get the URL and they should go after Thorsdale for selling the URL that they didn't own. IF we actually owned it when it was sold. Maybe DFC will just agree to pay us $1,000,000 to keep the URL and close this up.
