of calculating the payment to the CVR holders, the amount of such losses will be net
of any amounts actually recovered by CHS under insurance policies.

This is also directly from cyhhz original filing. Under these circumstances, if cyh can indeed recover up to 220 million under insurance, all monies held in trust will be returned to cyhhz holders if the settlement does not go over what insurance will cover.
This is very good news as the settlement ia likely under 200 million. This also means $1.00 payout is still on the table and very likely.
