Remand will be double work, back to PTAB, if they rule unfavorable to WDDD, WDDD will appeal again , then go back to CAFC, need to select new panel....Come on..., waste time and money, non sense. Why CAFC can't make decision now instead of returning PTAB? They should know the outcome, They are smart people but why have to remand (If).
It is so simple, just right or wrong, can't be between, more likely PTAB will rule the same way if it is remanded.
If remand this case will last to 2021. (in my opinion.). In 10 years lawsuit, break the record !
