They didn’t protect investors they screwed them. placing a mark on the company when a Third Party was doing a promotion that had nothing to do with the company in wrong.

The attorney opinion letter stated that as a fact.

Protecting investors is part of regulatory agencies not some independent news organization.

News gets sued all the time for libel, look at Hulk Hogan’s big win.

Pretty easy to prove in this case.
