I don't think it matters, unless Benny owns a multi-million dollar estate. An average house in Florida wouldn't be worth enough to pay the lawyer fees.
Unless Benny sheltered the money (or his publishing company has money), any class action lawsuit would need to go after the directors complicit in any bad faith actions, they participated in, that were detrimental to shareholders.
