Actually John - for a conservative investor knowing how this would stand in a bankruptcy proceeding is a useful thing.

I don't consider CHS to enter bankruptcy before this is resolved but its a none zero item. When you state:

Trust me also when I say cyh could disappear from the face of the earth and these funds would still remain. The cvr governs only hma shareholders that agreed so much money would be put into trust to resolve the settlements between doj and hma.



You need to read up on the history of DIMEQ. This was a similar litigation trust except it was the other way. The shareholders of the original security received a warrant that entitled them to a payout if a contract was won. This security traded hands and ownership many times and it always stayed intact until Wash Mutual was bought via JPM a day before bankruptcy in a bailout. In as shady of any deal in my entire life - JPM argued that the assets of the security could and should be disgorged from it due to bankruptcy (that never happened btw).

I'm not saying its likely in the case here but its not a non-zero concern for some. I lost a lot of respect for rule of law in this country on that day.
