The litigation is happening for many years now. But the dilution was causing that whatever happened to GERS that was positive, didn't show in the PPS, even though people kept on buying hoping it would change.

Now, since dilution stopped, we can see what effects the price. If you go back a few months, you'll see that at the time the chance on a settlement increased, the PPS also increased. With a stay announced it either dropped, or the price leveled and went down or up a bit more slowly.
Now (almost) everybody knows that the litigation still might take a while. People who are in, bought mostly in in the low cents level and hold on to their shares. People who want to buy, mostly hope for a better price. That's why the spread is so large. People are patient, because they know it still might take over a year until the lawsuit ends.
Once in a while drops in a small amount of shares to drop the price, or someone buys a small amount to rice the price. Also sometimes someone looses their patience or is just in need for some money. That's causing the swings.
We didn't see them before the last RS, because the dilution killed all hope. Now the dilution is gone, and you'll see this effect.
