I would put a lot more money on a bet that your claim that JB's info is bogus is less defensible than his claim that it's legit. The fact is you are in no position to make your claim because you have not seen the data JB is basing his own on. You keep saying that's evidence of some sort of intent to defraud, but to me the clear purpose of the NDA is to make it difficult for potential competitors to know where or when to stake claims.
