Agree with all of that.
Also frustrated and annoyed with delays.
We don't even know if there is a delay,
don't know what CAFC will decide or Oil States,
just know possibilities.
People say that remand was in briefs, and it was,
but nobody really discussed the odds or probability of
that happening. So many of us, including me were not really properly prepared to hear the Judges talk remand at length.
I was under the impression at least some of the claimslost would be talked about in Orals, and they did not really even discuss that.
District court is the promised land.
And it appears the vast majority of us think that is now going to be a little farther away and going to be a little longer to get there.
Still think we get there, but the new timeline or lack thereof
is concerning.
