They arent going to suspend anything if they are making an effort at getting it done and they let the company know before they do.

They send delinquency letters to many--but not all--delinquent filers. We don't know whether MSPC has received one. They aren't obliged to disclose that.

And they aren't particularly sympathetic to companies that have made no effort to catch up, and suddenly say, "Oh, we'll get right on that!" They're aware of their obligations. They get one chance: to comply speedily with the delinquency letter.

Once a company has been served with an OIP for delinquency, no excuse it may present will have any effect.
