Actually, one of the judges raised 101 sua sponte and chose to kill the patents

This is why it’s been raised here many times- the issue of judges who are anti patent is a major risk

1. The grounds upon which the vrng patents were killed was not addressed by the defendants / google

2. The judges raised the issue themselves and HELPED google

3. If judges have a anti patent philosophical stance, it’s very easy outside of using 101 to use precedents to defend their views - the law is grey not black and white, there are precedents on both sides - law is subjective and the cafc and patent issues are well known for contradictory rulings case to case

Perhaps do some additional research to understand the actual risks in wddd
