So does that mean there's a problem or not?

Doesn't really say definitively, does it? I appreciate that it says they are addressing any potential problems. I would expect Frank to do that. But would it not be safe to assume based on present filings that Will McCusker is not a part of this company, either as a significant shareholder or as an officer?
