Oh, come on. That is not what he meant.

What he means is that courts will likely side with the govt because _____ ( fill in the blank, they're in on the game, they're serving the govt, they can care less, they're corrupt, etc). so for practical matters, we can't rely on them to deliver us to a favorable outcome.

With the exception of Sweeney, the outcome is obvious. We will in all likelihood, lose. So the only utility these serve is the mere theoretical possibility of a win for the plaintiff.

So for practical matters, the only game in town is the administrative reform.
