There is no incongruency in what Bradford said.

Govt has to settle the outstanding cases even if they decide to recap and release. Otherwise the cases will continue with the possibility of a court later giving a win to the plaintiff that grants damage awards and clawbacks. They also need some assurance that new cases won't pop up like a whack-a-mole to eternity. So they have to clean the slate before a new system can begin.

Even with a liquidation, they may have to settle some remaining cases. Even Corker came to this realization recently
