Practically if Simpson wins votes when they count, she is the true owner. I see the major problem is this last offering was a bad deal. I don't know if anybody could have done better, that is strictly academic.

I knew for certain I did not like the offering, when warrants could not be executed for one year unless it bumped up the unit price.
