Poor analysis. I read the entire ruling and the problem wasn't that Finjan used the $8/user. The problem is they couldn't show they use that formula with past license deals. If they had used it previously, the court would have upheld it.

The analysis seemed to suggest Finjan used an improper methodology. The methodology was fine... it just was not proper in this particular case since they had no precedence with it in their own past licensing deals.
