It’s actually not true. I checked with a couple brokers, and it’s literally in every TOS you sign, brokers can and do short your shares all the time, regardless of what you do. Scottrade is notorious for this, which is why they will periodically put a hold on the pinks and your ability to trade them. You can call your broker and specifically tell them that you don’t want your shares shorted, which in turn usually requires some kind of written deal to them, but without, they can and do. At least that’s what my DD has turned up on the 4-5 brokers I called and checked.
