I just promised to stop talking "judges" and here I am responding to your post, but Mayer, without rational basis in law and without conscience, did exactly what you said he did to Vringo.
A "maverick" judge (like Mayer or Dyk) plays by his own rules
and isn't constrained by prior case law. I had the Vringo case in mind when I wrote an earlier post about judges. Mayer was wrong on the law, wrong on its application, and Vringo fell into the abyss because of it.
OK- done. This is not a resolvable discussion. Like mad says,
let's hope Dyk and Mayer are on vacation in March.
BTW, thanks for the math analysis. JJ




If Mayer is on the panel hearing WDDD appeal, what is the chance that he will UNILATERALLY bringing up the issue of Alice/101? It is a scary thought, isn't?
