If they get a large settlement, I think they should do a share buyback and take the remaining shares of BCPI and Israel Seed. I'll bet each would be happy to get $2.50/share and it would cost about $15M total. That $15M would result in share price going up since those speedbumps will be gone and probably raise market cap to higher than before the buyback. A definite Win-Win.
