I think it's logically from GERS point of few....but if there wouldn't be a complete settlement, and only some would settle and some would go for the appeal, would it make sense for Valero to settle with GERS if they aren't sued yet? I don't think so...I think that they would have waited in that case, to see how the lawsuit works out.
