Technically yes. But if it is true that Valero, who isn’t even a defendant yet is becoming a paying client then it seems like all parties, even those who aren’t sued are willing to respect GERS’s patent. Then I think that nobody is willing to let the judge decide.
The only problem is to find a settlement that does right to the interest of all parties.
