He also seems to suffer the misconception that hostile takeovers (ie bypassing the BODs) is a plausible strategy, or that it is common. It isn’t. Someone name the last baby bio that was taken over in a hostile bid. Once you announce that you are interested in buying the company, the stock quickly rallies to either fair value or higher, based on speculation. It also often brings in other acquirers. If a BP were to announce a hostile bid at 10 the stock would be at 20 before you could blink.
