That's called a Type 2 error and well known to happen, post hoc. Of course, there are also Type 1 errors which are the opposite: concluding the drug works when it does not.

But a researcher cannot design a test, decide the n and confidence interval, perform the test, attest to proper design and performance, and then disavow the conclusions when he doesn't like them.

What he can do is keep testing.
