Of course they should. It is the law that determines how a judge should rule. That is the standard that judges use...what is the law. You seem to think there is some aspect of right and wrong in a judges ruling...and Im going to tell you that there is not. There is only against the law and the law.

Laws cannot violate rights. Laws establish rights. The laws tell you what you can and can not do.

If a law has been passed that is unconstitutional, then judges can only address that unconstitutionality in a case brought before them directly challenging then unconstitutionality. Otherwise, the judge must abide by the law as it exists.
