It is NOT a judges job to challenge an unconstitutional law.
It is the plaintiffs job to challenge an unconstitutional law. The judge can then rule on whether he agrees with the plaintiffs argument.
People seem to think it is the judges job to file the complaint and rule on it all by themselves. They are only one piece of the equation.
And by the way...all of this is based on the assumtion that HERA ACTUALLY violated constitutional law. Of which, I am not so sure is actually true.
